PLEASE NOTE THAT THE TERMS OF USE, PURCHASE TERMS AND/OR PRIVACY POLICIES OF GOPILLAR ACADEMY AND ITS SERVICE MAY CHANGE OVER TIME FROM THE TERMS HEREIN SO PLEASE MAKE SURE TO CHECK THE TERMS AND POLICIES REGULARLY BEFORE USING OUR SERVICES.

PLEASE NOTE THAT THE USAGE TERMS, PURCHASE TERMS AND/OR PRIVACY POLICIES OF THIRD PARTY SERVICES LINKED TO OR FROM THIS SERVICE MAY VARY FROM THE TERMS HEREIN SO PLEASE MAKE SURE TO CHECK THE TERMS AND POLICIES APPLICABLE TO SUCH OTHER PRODUCTS AND SERVICES PRIOR TO USE.

BY USING OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE TERMS OF USE AND AGREE TO BE BOUND BY THEM. YOU AGREE TO USE THE SERVICE IN A MANNER CONSISTENT WITH ALL APPLICABLE US LAWS AND REGULATIONS AND IN ACCORDANCE WITH THE TERMS OF USE. DO NOT USE THIS SERVICE IF AT ANY TIME YOU DO NOT AGREE WITH ANY PART OF THE TERMS OF USE.

GoPillar Academy is a platform designed to provide professional and technical e-learning training services for Engineers, Architects, Surveyors, 3D Artists, Interior Designers, Students and industry enthusiasts. The platform, in all its services and all its parts, is managed by CoContest Inc. (hereinafter “CoContest“), an US company having its registered offices in 405 Howard Street San Francisco, CA 94105-2669. 

CoContest Inc., operating under the trade name GoPillar Academy, provides this site and all related services and applications (hereinafter collectively referred to as “Services”, as defined below). The Services may be delivered to You via the specific website that can be opened from a browser or, where possible, from an App (for mobile or other devices).

Anyone who uses www.gopillaracademy.com (hereinafter the “Portal“, as defined below) is subject to the Terms and Conditions set out below, as well as to the relevant Privacy Policy. In this document, reference is generally made to those who read these Terms and Conditions (hereinafter “You” or “User”, as defined below) as anyone who uses the Portal and, starting from their first visit, registers and uses the Services and features provided therein, thereby signifying agreement to these Terms and Conditions. If You have any questions or concerns about these Terms of Use, please contact us BEFORE You begin using our Services.

Registration is required to use all the interactive features available on the Portal, such as viewing video lessons, downloading final certificates or educational materials, participating in quizzes and assessments and, in general, for any operation and function of the Portal in which the Users provides information to GoPillar Academy about themselves.

You must be 18 years or older to register with the Portal. GoPillar Academy reserves the right not to accept registrations from minors where it is aware of this. However, GoPillar Academy declares that it is not able to monitor the irregular behavior of its registered Users at all times. Users (as defined below) who shall accomplish an underage registration shall do so at their own personal risk, and GoPillar Academy will not accept any kind of liability on the matter and reserves every right to take any appropriate action against illicit activities carried out on the Portal.

To register a User Account on GoPillar Academy, You will be asked to provide “Personal Information” such as, but not limited to, username, password, email address, social security number, valid telephone number and other personally-identifying information in accordance with the Privacy Policy which we recommend You read before completing registration and which You are required to accept in order to register on the Portal.

All data collected shall be treated only for the purposes allowed by Law, in accordance with the aforementioned Privacy Policy of GoPillar Academy, which is an important part of these Terms of Use and may be updated from time to time.

Now therefore, simultaneously with the Registration, the User, having taken due notice of the above, which is considered entirely accepted, agrees to the following:

1. CHANGES IN TERMS OF USE

1.1) GoPillar Academy has the right to change or modify these Terms of Use at any time, including the Privacy Policy applicable to Your use of the Services. Such changes or modifications shall be effective immediately upon notification via digital means, including, but not limited to: publication within the Portal in the appropriate section, electronic or conventional mail, messaging or any other means through which You may obtain notice of the changes. Any use of the Service by You subsequent to such notice shall be deemed to constitute Your acceptance of such changes or modifications.

2. USER ACCOUNT

2.1) For the purposes of these Terms and Conditions the following definitions will apply: 

1. “Portal”: the website referred to at www.gopillaracademy.com or any other URL where CoContest chooses to provide GoPillar Academy Services as shall be communicated to Users from time to time.
2. “User”: any User of the Portal who has successfully completed the registration procedure.
3. “Services”: any digital service and/or product offered by GoPillar Academy over time (including, but not limited to: e-learning courses, e-books, product licenses, etc.) that may be purchased on our Portal.
4. “Personal Area”: the personal page that is created for each User who has successfully registered, which can only be accessed by entering a personal email and password, and in which it is possible to access most of the Services made available by GoPillar Academy.
5. “Payment Page”: any page on our Portal where the registration of the Users can be completed and where they may be able to simultaneously, or at a different time, purchase one or more of our Services.
6. “Order”: any outright purchase, verified by sending a completed form via the Payment Page or via email to the GoPillar Academy Team, of one or more of our Services.
7. “Video-Courses”: in particular, among the Services we offer, the term refers to the provision of synchronous or asynchronous FAD Training linked to particular topics of interest in the sector via the video format, accessible on our Portal or on any other URL where CoContest chooses to provide its services.

2.2) In order to access all GoPillar Academy’s Services You will have to register and activate a User Account. You are not allowed to use another User’s Account, as unauthorized use constitutes infringement of the Law. When registering Your account, we require You to provide us with accurate and complete information about Yourself.

2.3) You are solely responsible for the activity that occurs on Your account, therefore You must keep Your account credentials safe; failure to do so will result in Your liability for any illicit activity that occurs on Your account using Your login data. You may change Your password at any timethrough Your Personal Area, in the Profile Settings section. 

Furthermore, You agree to immediately notify GoPillar Academy of any unauthorized use of Your password or account or of any other breach of security You may experience. GoPillar Academy will not be liable for any loss or damage arising from failure to comply with these provisions, nor will we be liable for breach or unauthorized access or any other event depending on the behavior of the User.

2.4) GoPillar Academy may decide at its discretion to close and/or suspend any User Account, even without prior notice, if it deems it necessary to protect its business interests and/or similar reasons and/or is ordered to do so by any competent Authority.

2.5) After registering as a User, GoPillar Academy hereby grants You permission to use the Portal as set forth in these Terms and Conditions, provided that the User guarantees to: 

1. Not copy or distribute any part of the Portal or Video Content or Files or any other Content in any medium or form without the prior written authorization of CoContest;
2. Not alter or modify any part of the Portal other than as may be reasonably necessary to use the Portal for its intended purpose under the present Terms and Conditions; 
3. Not utilize any third party software, code or hardware to alter or modify any part of the Portal and/or its underlying mechanisms;
4. Not use or launch any automated system, including, but not limited to, “robots,” “spiders,” “automatic form fillers,” or similar technological devices or programs, that access GoPillar Academy in such a manner as to send a series of request messages to GoPillar Academy’s servers in a given period of time greater than a human can reasonably produce in the same period of time by using a conventional online web browser.

2.6) After registering as a User, it will be possible for You to change the login email, user name and surname only after sending a written and reasoned request via email to admin@gopillar.com. GoPillar Academy reserves the right to accept or reject such requests according to its discretion. Under no circumstances is it possible to transfer Your account to another User, as established in these Terms and Conditions, under section 7).

2.7) If You do not agree with any part of this document and/or the associated privacy policy, we ask You to immediately discontinue use the Portal and You are not authorized to register. If You are already registered, please contact GoPillar Academy and request the immediate removal of Your account as it is invalid. Use of the Portal in violation of these Terms and Conditions will force GoPillar Academy to terminate Your account and/or take any necessary legal action.

2.8) Notwithstanding the foregoing, GoPillar Academy grants the operators of public search engines permission to use spiders to copy materials from GoPillar Academy for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. GoPillar Academy reserves, in any case, full right to revoke such exceptions both in general and in specific cases, at its sole discretion.

3. USER LICENSE

3.1) You are granted a limited, personal, non-exclusive, non-assignable and non-transferable license to access and use GoPillar Academy’s Services for non-commercial, personal use only. You may not adapt, download, revise, transmit, reverse engineer, duplicate, publish, modify, broadcast, display, perform, transfer or otherwise distribute any content or other material on the Portal unless expressly authorized by GoPillar Academy or these Terms of Use.

Under no circumstances may a User of the GoPillar Academy’s Services:

1. Frame or utilize framing techniques to enclose any portion of the Services;
2. Collect, obtain, use, access or otherwise copy any portion of the Service by using any bot, spider, crawler, spy ware, engine, device, software, or any other automatic device, utility or manual process of any kind;
3. Use the Services or any features available on the Services in any manner with intent to interrupt, damage, disable, overburden, or impair such Services;
4. Engage in any activity that interferes with another User’s access, use or enjoyment of these Services.

Use of the Services for any purpose other than as contemplated in these Terms of Use constitutes a violation of the proprietary and copyright rights of GoPillar Academy and/or its licensors.

3.2) Neither GoPillar Academy nor its licensors guarantee the accuracy or completeness of any information or content on the Portal. You agree that You must evaluate, and bear all risks associated with the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content. All rights not expressly granted herein are reserved by GoPillar Academy.

3.3) Certain features of these Services may be provided by third parties (e.g. Software Licenses etc.) and the use of such features may be conditioned upon Your agreement to the Terms of Use and Privacy Policies of such third parties. The User understands that these Terms of Use apply only to those portions of the Services that reside on GoPillar Academy’s (or its service providers’) servers and not to those that reside on third-party servers not controlled by GoPillar Academy.

4. PRICES AND PURCHASES

4.1) All prices for the Services provided by GoPillar Academy are set out at any time on our Portal are to be considered VAT excluded in any EU country as per European Law and tax inclusive in any other rest of the world country. GoPillar Academy reserves the right to vary its prices at any time without the need to notify Users.

For the avoidance of doubt, any costs associated with the use of our Services, the use of our Video Courses or the download of the material provided on the Portal (by way of example only: a functioning Internet connection, the use of third-party software licenses etc.), are at the User’s own expense and must be considered in addition to the prices provided on the GoPillar Academy’s Portal.

4.2) The Payment Pages of our Portal will guide You through the steps You need to take to make a purchase of one of our Services. Our Order process allows You to check and amend any errors before submitting Your Order to us. We encourage You to take the time to read and review Your Order at each page of the order process. By placing an Order, You confirm that the details contained in the Order are correct in all respects. Once You have placed an Order and we have received Your payment, we will send You a confirmation email that Your Order and payment have been accepted and it will no longer be possible to make changes to Your Order.

4.3) Included in the price, Users who purchase a Video Course will have the opportunity to join the dedicated Facebook ® group managed by GoPillar Academy in the language in which the course was purchased, where the User may ask questions relating to the Video-Course purchased, directly to the course instructor as well as to the GoPillar Academy’s team of professionals. The dedicated Facebook ® group is private and will only be accessible upon proof via invoice that You have actually purchased one of the Video Courses on GoPillar Academy. Other Services purchased on GoPillar Academy other than Video Courses will not guarantee access to the dedicated Facebook ® group. The purchase of a Video Course on GoPillar Academy gives the right to access the dedicated Facebook ® group for a single (1) participant only.

At any time GoPillar Academy reserves the right to expel any participant and/or User from the Facebook ® support group in case of violation of these Terms and Conditions or of the Terms and Conditions set forth on the information page of the aforementioned Facebook ® support group.

The Facebook ® infrastructure and its related services are tools external to those belonging to GoPillar Academy. Any use by You of optional tools offered through the site is entirely at Your own risk and discretion and You should ensure that You are familiar with and approve of the Terms of Use of the platforms on which tools are provided by the relevant third-party provider(s).

5. PAYMENT TERMS AND INVOICING

5.1) Purchases of our Services can be made exclusively online on GoPillar Academy’s Portal. The person placing the Order must be at least 18 years old and, through the order process and payment for the Services, accepts the Terms and Conditions. GoPillar Academy deems it undisputed that by purchasing one of the Services the User declares to have read these Terms and Conditions. Users are also responsible for the accuracy of their personal details, with particular reference to billing data. GoPillar Academy is required to respond to Users only in the event of cancellations or disputes.

5.2) The User must make full payment at the time of purchase. Users will be required to pay for their Order by making a payment via credit or debit card or bank transfer or any other payment instrument offered by GoPillar Academy at the time of the placing of the Order. GoPillar Academy does not accept deposits or partial payments or installment payments with the exception of those made through the tools offered by GoPillar Academy itself at the time of the Order (e.g. installment payment via PayPal, Afterpay etc.). To find out more about the online payment services offered by GoPillar Academy at any given time, please visit our Payment Page or contact our Team via dedicated channels. Payment methods other than those specifically provided on the Payment Page of our Portal will not be accepted. We remind You that for Subscription packages (as defined below in section 9) of these Terms and Conditions) payments in installments or by bank transfer will not be possible.ù

5.3) Once GoPillar Academy has received payment for the Order from the User, GoPillar Academy will automatically enable the User to access the purchased Services, in particular by unlocking the Video Course lessons on the User’s Personal Area. The User will be able to immediately access the Services purchased unless otherwise specified on the Payment Page or otherwise notified via email by the GoPillar Academy’s Team. The Video Courses will be accessible only through our Portal and only after the User has completed the login procedure.

Unless otherwise agreed with GoPillar Academy’s Team, the User will ensure that GoPillar Academy receives the payment prior to enjoying the online Video Course.

5.4) All prices advertised on our Portal are correct at the time of the Order. However, GoPillar Academy reserves the right and discretion to change its prices at any time. We invite You to check our Portal for up-to-date prices and special offers before purchasing any of our Services. No change of price will be applied to Your purchase once the purchase process is completed.

5.5) If Users purchase through the Scalapay service, they will immediately receive the activation of their Order in their Personal Area and will be able to pay the due fee in 3 installments. The User acknowledges that the installments will be transferred to Incremento SPV S.r.l., a company that provides the microcredit service through the Scalapay brand, to related parties and its assignees, and to authorize this transfer.

5.6) Each time a User (private and/or company and/or public administration) purchases one of our Services on our Portal, GoPillar Academy will issue the relevant invoice, as per the laws and regulations applicable in the US. The courtesy invoice in PDF will be sent via email and will also be available for download in Your Personal Area on the Portal, in the “Billing” section.

5.7) You agree to be responsible for collecting and/or paying any and all taxes for which You may be liable in any jurisdiction arising from Your purchases on www.gopillaracademy.com. GoPillar Academy is not responsible for collecting, reporting, paying or remitting to You any direct/indirect taxes and/or social security charges and/or tax relief of any kind.

6. COUPONS

6.1) Users can access GoPillar Academy’s Services also by redeeming Gift Cards and/or Discount Codes for the total or partial amount of the list price. All Gift Cards and/or Discount Codes have the following conditions of use:

1. They are not refundable and/or redeemable for cash;
2. They are valid for one (1) use only, unless otherwise specified by communications from the GoPillar Academy’s Team;
3. Gift Cards and/or Discount Codes CANNOT under any circumstances be added retroactively; Gift Cards and/or Discount Codes MUST be used in the appropriate section of the Payment Page before the checkout is completed;
4. Any Gift Card and/or Discount Code cannot be used together with another Gift Card and/or Discount Codes cumulatively within the same Order;
5. Gift Cards and/or Discount Codes cannot be used to order printed materials;
6. Gift Cards and/or Discount Codes can only be used within the time interval specified in the offer by communications from the GoPillar Academy’s Team.

6.2) Gift Cards and/or Discount Codes are personal and cannot be transmitted to third parties other than the User to whom the Gift Card and/or Discount Code is addressed unless otherwise specified by communications from the GoPillar Academy’s Team.

6.3) As regards the Discount Codes strictly reserved for University Students, as indicated in the communications made by the GoPillar Academy’s Team and its Affiliates, they can only be used by Users who complete the Order using an university student email valid and active at time of completion of the Order.

All communications related to Video Courses or other Services purchased through Discount Codes reserved for University Students will be sent to the university student email address entered when completing the Order, without exceptions, including the sending of Final Certificates. Under no circumstances can the email linked to Video Courses or other Services purchased through Discount Codes reserved for University Students be replaced by the User or GoPillar Academy’s Team.

At any time GoPillar Academy’s Team may ask the User who has used Discount Codes reserved for University Students to verify the correctness and validity of the email address entered when completing the Order. If the email address is found to be incorrect, false, inactive or invalid, at any time GoPillar Academy’s Team reserves the right to request that the User who has used Discount Codes reserved for University Students in violation of these Terms and Conditions for an addition to the price paid to align it with the list price of the course or with any other currently valid offer that is not strictly reserved for University Students, as indicated by GoPillar Academy’s Team and at its sole discretion.

6.4) USERS ARE RESPONSIBLE FOR THE CORRECT USE OF THE GIFT CARDS AND/OR DISCOUNT CODES AND NO REFUND SHALL BE GRANTED IN THE EVENT OF VIOLATION OF THEIR CONDITIONS OF USE REFERRED TO IN THE PREVIOUS PARAGRAPHS.

7. CANCELLATION AND SUBSTITUTION POLICY

7.1) Once You have purchased one of our Services, the fee is non-refundable and the purchase is not transferable to another person. If You cancel Your account, stop taking or cancel a Video Course, You will not be entitled to any refund, nor will You be able to transfer Your purchase to another person or to another Video Course.

7.2) Refunds and/or replacements of Video Courses and/or other Services purchased are permitted only if a fully justified request is sent via email to admin@gopillar.com within 24 hours from the purchase, as per the precise date shown on the Order page or on the Invoice.

In any case, GoPillar Academy reserves the complete discretion to accept or reject the User’s request for refund and/or replacement where the request is not motivated by serious misconduct on the part of GoPillar Academy. No refunds and/or replacements are permitted after 24 hours from the purchase of the Service or if the Video Course has already been started or if the relevant material has already been downloaded by the User. Under no circumstances are refunds and/or replacements of Subscription packages possible after the payment and/or renewal process has already begun.

7.3) Access to Video-Course may be terminated by written notice in the event of a substantial violation of these Terms and Conditions. If we reasonably believe that your violation of these Terms of Use affects the legitimate operation of our Portal or third-party customers, we may suspend Your access to the Services at any time.

7.4) GoPillar Academy reserves the right, at its sole discretion, to cancel, modify the content of the Video Courses, discontinue the Video Courses and other Services related to them at any time. In the event that a Video Course is canceled or discontinued, You will be contacted by us and have a period of 30 days to enjoy the Video Course and download the relevant material, prior to the definitive cancellation. No refunds will be granted upon the expiration of this 30 days period without You having enjoyed the course.

8. COURSE PREREQUISITES AND DURATION

8.1) Each User shall meet the prerequisites specified for the Video Course they wish to attend. For the avoidance of doubt, it is the User’s responsibility to ensure that he or his delegates meet the prerequisites of the Video Course. It is also Your responsibility to ensure that the Video Course purchased is suitable for Your purposes and needs.

8.2) Starting from the update of these Terms and Conditions carried out on November 1st, 2019, GoPillar Academy guarantees access to each User who purchases one or more of our Video Courses for a period of five (5) years. After that period of time, GoPillar Academy reserves the right to offer Users an extension of the duration of the Video Course free of charge or upon payment of a sum determined at the sole discretion of GoPillar Academy. GoPillar Academy may decide to offer Users an extension of the duration of the Video Course or to discontinue the Video Course altogether if it deems it obsolete, if a new version of the same Video Course is available on the Platform, or for any other reason that GoPillar Academy deems appropriate to protect its business interests. The User will be informed via e-mail by GoPillar Academy’s Team at least thirty (30) days before removing access to the Video Course from the User’s Personal Area.

8.3) For each Video Course purchased before the date of November 1st, 2019, GoPillar Academy guarantees lifetime access. However, even for Video Courses purchased before the aforementioned date we reserve the rights stated in these Terms and Conditions under section 7.4.

9. SUBSCRIPTION

9.1) Starting from the update of these Terms and Conditions carried out on July 1st, 2021, GoPillar Academy offers Users the possibility of accessing the Video Courses and some other Services via the “Subscription” mode. Subscription packages require the payment of a monthly or annual fee to ensure the continued use of the Services by the User who signs up for one of the Subscription packages. Upon completing the Order of a Subscription package, the User accepts the automatic monthly or annual renewal of the Subscription itself, subject to the periodic and automatic payment of the fee via the payment method chosen by the User, as well as clearly indicated on the Payment Page. 

At any time the User has the right to deactivate the automatic renewal of the Subscription for the period following the one already subscribed and paid for via the appropriate button located within his Personal Area, in the “Subscriptions” section. GoPillar Academy guarantees the continuation of the provision of the Service for the period already paid for by the User even in the event of deactivation of the automatic renewal of the Subscription before the expiry of the reference period.

9.2) GoPillar Academy does not place any minimum or maximum restriction on the duration of the Subscription packages other than that of the first period (monthly or annual) already paid in the case of the first subscription to the Subscription package. The User accepts that the deactivation of the Subscription cannot in any way be retroactive with respect to the period already paid but will be applied starting from the Subscription period following the date on which the deactivation of the Subscription packages occurred. Users also agree that he shall correctly inform himself on the expiration and automatic renewal date of his Subscription package, as clearly communicated in their Personal Area, in the “Subscription” section; and that to avoid incurring in unwanted fees or payments, the User must deactivate automatic renewal using the appropriate button at least one (1) minute before the deadline for automatic renewal and withdrawal of the monthly or annual fee.

The User agrees that the Subscription period is always considered paid in full and that GoPillar Academy does not accept under any circumstances and without exception partial payments or payments for Subscription periods shorter than those provided for in these Terms and Conditions (on a monthly or annual basis); nor will GoPillar Academy provide under any circumstances and without exception partial refunds requested before the end of the Subscription period already subscribed and paid for.

9.3) Users accepts that, once they have subscribed to the Subscription package, it is their sole responsibility to enjoy the subscribed Services as offered by GoPillar Academy, and that GoPillar Academy, once provided complete access to the subscribed Services, is not in in no way responsible for the failure or partial use of the Services subscribed to during the paid Subscription period. No exception for any reason will be taken into consideration by the GoPillar Academy Team, unless the User demonstrates serious negligence on the part of GoPillar Academy which prevented the User from accessing the subscribed and paid Services.

9.4) Once the automatic renewal of the Subscription package has been deactivated, and once the Subscription period already paid for has expired, the User will no longer have access to the Video Courses and Services included in the Subscription package subscribed to, except for any Video Course and/or Service previously purchased outside of the Subscription package, for which the duration terms described in these Terms and Conditions, under section 8) apply. Under no circumstances may the User retain access to the use of the Video Courses and Services included in the Subscription package subscribed to after its expiration and deactivation, except for any materials and files downloaded during the Subscription period (for example: attendance certificates, teaching materials, CAD files, etc.). GoPillar Academy guarantees the conservation of the progress made by the User during the Subscription period for a period of six (6) months from the deactivation of the same, period in which the User can reactivate, if he wishes, his Subscription package without losing the progress made.

9.5) Subscription packages guarantee the User access to the Video Courses published on the Portal, on the “Courses” page, as listed at the time of completing the Subscription Order. Other Video Courses or Services (for example: tutorials, e-books, the Official Certificates Issuance service, etc.) may be included in the Subscription packages at the sole discretion of GoPillar Academy. GoPillar Academy reserves the right to vary at any time the set of Video Courses and Services offered in the various Subscription packages available, obliging itself to notify such changes within a reasonable time only to users already registered for the Subscription packages on which the changes will have effect. GoPillar Academy does not guarantee the presence in the Subscription packages of Video Courses or Services other than those subscribed to when ordering the Subscription package. At any time it will be possible for the User to know the composition of the set of Video Courses and Services offered in the various Subscription packages available by contacting the GoPillar Academy Team via the dedicated channels or by emailing admin@gopillar.com.

9.6) The price of the recurring subscription fee is established by GoPillar Academy at its total discretion and can be consulted at any time on the Portal on the dedicated page https://www.gopillaracademy.com/it/academy-subscriptions/ or can be requested from the GoPillar Academy Team via the dedicated channels or via email at admin@gopillar.com. GoPillar Academy reserves the right to change the prices of the recurring subscription fee for Subscription packages at any time at its sole discretion, upon notification to Users already registered for a Subscription package at least fifteen (15) days before the renewal payment of the automatic fee takes effect with the new prices established.

9.7) GoPillar Academy will not provide any of the additional Services during the 7-day Free Trial Period of the Subscription packages, including, but not limited to, membership in any support group, issuance of Final Certificates and/or the awarding of Professional Credits.

9.8) YOU AGREE TO BE SOLELY RESPONSIBLE FOR THE CORRECT MANAGEMENT OF YOUR SUBSCRIBED SUBSCRIPTION PACKAGE AND AGREE TO BE PROPERLY INFORMED ABOUT THE RECURRING SUBSCRIPTION FEES, EXPIRES AND RENEWAL TERMS APPLICABLE TO YOUR SUBSCRIPTION PACKAGE. NO REFUND WILL BE GRANTED IN THE EVENT OF A VIOLATION OF THESE TERMS OF USE REFERRED TO IN THE PREVIOUS PARAGRAPHS.

10. CERTIFICATES

10.1) Each User who attends a Video Course will receive a PDF copy of the GoPillar Academy Attendance Certificate via email within 7 days of completing the Video Course. The Certificate will also be available for download in Your Personal Area of ​​the Portal, in the “Certificates” section.

10.2) If You would like to receive a paper copy of Your certificate there is a charge of $25 for each Certificate.Once requested GoPillar Academy will do everything possible to make sure that You receive Your certificate within 30 days of completing the course. However, we do not take any responsibility for any postal service problems, which might delay Your certificate and we do not take responsibility for a lost certificate due to in-country postal problems. We can provide proof that the Certificate was sent to Your confirmed postal address. This covers all geographic locations.

GOPILLAR ACADEMY CERTIFICATE HAS NO LEGAL VALUE AND DOES NOT CONSTITUTE A VALID QUALIFICATION FOR THE PURPOSES OF PUBLIC COMPETITIONS OR FOR UNIVERSITY SCORES. THE CERTIFICATE CAN INSTEAD BE USED TO ENHANCE YOUR CV  AND DEMONSTRATE SPECIFIC SKILLS.

11. ACCREDITED COURSES

11.1) If one or more of the Video Courses purchased are recognized Video Courses that provide Certification in a particular subject, program or assessment, successful completion of the assessments is governed by any applicable rules in relation to the accreditation. The Terms of Use of the Video Courses as well as the cost of the Video Courses may undergo variations in accordance with the provisions of law or applicable Regulations.

11.2) If one or more of the Video Courses purchased are recognized Video Courses that provide an Official Certification for a specific Software, the terms and methods of provision of the Official Certification will be established by GoPillar Academy’s team and notified to the User before or after the Purchase Order for an accredited Video Course through the dedicated channels, through the dedicated pages on the Portal or via email. Users agree to inform themselves about the terms and methods of delivery through the dedicated channels before completing the Purchase Order for an accredited Video Course, in order to ensure that they comply with their specific needs.

12. RESALE OF THIRD PARTY SERVICES

12.1) GoPillar Academy may offer third-party services for resale on its Portal (for example: software licenses, etc.). In the event of purchase by the User of a third-party Service for resale, GoPillar Academy’s obligations towards the User end within the scope of the correct activation of the purchased Service and, therefore, when the User obtains full access to the purchased Third Party Service and starts using it for the first time.

12.2) In no way is GoPillar Academy responsible for malfunctions, errors or interruptions of the third-party Services purchased for resale by the User after the activation of the same Service, if the malfunctions, errors or interruptions of the Service are due to the responsibility of the aforementioned third parties and are not in any way deriving from serious negligence by GoPillar Academy or by GoPillar Academy’s Team. GoPillar Academy’s Team may provide support through dedicated channels to Users who have purchased a third-party Service for resale on the GoPillar Academy Portal. However, being unable to operate directly on the Service or on third-party servers, GoPillar Academy in no way guarantees that the assistance provided is complete, satisfactory or resolving the malfunctions, errors or interruptions encountered during the use of the third-party Service that may emerge due to the responsibility of the aforementioned third parties and are in no way deriving from serious negligence by GoPillar Academy or GoPillar Academy’s Team.

13. INTELLECTUAL PROPERTY RIGHTS AND TRADEMARKS

13.1) The contents available on the Portal are the property of GoPillar Academy, protected by copyright, registered as intellectual property or otherwise licensed to GoPillar Academy and generally protected by intellectual property rights as provided for by the US Law. Contents include the registered intellectual property of CoContest INC. protected under international treaties. They may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed or otherwise exploited for any purpose whatsoever, without the prior written consent of CoContest INC. or as expressly provided herein. CoContest INC. reserves all rights not expressly granted in and to the Portal and all related contents and Video Courses.

13.2) The User expressly undertakes not to use, copy or distribute any of the Content and/or Video-Courses, except as permitted in these Terms and Conditions, within the statutory limits applicable by law. The User agrees to maintain conduct in compliance with the applicable US laws and regulations and/or any other applicable law/jurisdiction. Any behavior and/or action (explicitly including copying, downloading, printing, transcoding, creation of derivative works, etc.), which is not expressly approved by the specific functions present on the Portal, is to be considered as prohibited and may be prosecuted in accordance with the law.

13.3) The entire contents of the Portal and any other supporting Portals are the property of GoPillar Academy and/or its licensors and are protected by US and international copyright laws and other intellectual property laws. Reproduction, redistribution, modification or publication of any part of the Portal or the Services included therein without the express written consent of GoPillar Academy and/or its licensors is strictly prohibited.

13.4) Unless otherwise indicated, the trademarks appearing on this Portal are trademarks of GoPillar Academy or its affiliates. All other trademarks not owned by GoPillar Academy or its affiliates that appear in the Portal are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by GoPillar Academy or its affiliates. You agree not to reproduce, display, disparage, dilute or contaminate our trademarks or use any confusing similar trademarks or use our trademarks in such a manner that misrepresents ownership of such trademarks. Any permitted use of our trademarks by You shall be to the benefit of GoPillar Academy.

13.5) If You have any copyright concerns about any materials posted on the Service by others, please let us know. We comply with the provisions of the Digital Millennium Copyright Act applicable to Internet service providers (17 U.S.C. § 512). Unless otherwise stated in any specific DMCA designation provided by GoPillar Academy, please provide us with written notice (“Notice”) by contacting us.

To be effective, the Notice must include the following:

1. A physical or electronic signature of the owner, or a person authorized to act on behalf of the owner, (“Complaining Party”) of an exclusive right that is allegedly being infringed upon;
2. Information reasonably sufficient to permit GoPillar Academy to contact the Complaining Party, such as an address, telephone number, and if available, an electronic mail address;
3. Identification of the allegedly infringing material on the Service (“Infringing Material”), and information reasonably sufficient to permit GoPillar Academy to locate such material on the Portal;
4. Identification of the copyrighted work claimed to have been infringed upon (“Infringed Material”), or if multiple copyrighted works on the Portal are covered by a single Notice, a list of each copyrighted work claimed to have been infringed (please be specific as to whichInfringing Material is infringing on which Infringed Material);
5. A statement that the Complaining Party has a good faith belief that use of Infringing Material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
6. A statement that the information in the Notice is accurate, and under penalty of perjury, that the Complaining Party is the owner or is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

14.1) You may have been linked to the Portal from a third-party website, and the Portal or Portals linked to it may also provide links to other third-party websites or resources (collectively, “Third-Party Websites “). Because we do not control such Third Party Websites, You acknowledge and agree that GoPillar Academy is not responsible or liable for the content, products or performance of such Third Party Websites, and You hereby irrevocably waive any claim against GoPillar Academy in connection with such Third-Party Websites. GoPillar Academy reserves the right to terminate any link at any time without notice.

The inclusion of a link to such Third Party Websites does not constitute or imply an endorsement, authorization, sponsorship, or affiliation by GoPillar Academy of such Third Party Websites or any products or services provided therein. The information practices of such Third Party Websites are not covered by these Terms of Use or any other policies or terms applicable to our Service. We recommend that You review any Terms of Use and Privacy Policy of such Third Party Websites linked to our Portal and/or Service before providing any information to such websites or using their products and services.

14.2) Please note that the Portal may also provide links to other sites brought to You by by GoPillar Academy or by GoPillar in general. The Privacy Policy and Terms of Use of other GoPillar Academy’s or GoPillar’s websites may vary from these Terms of Use. Please review the Privacy Policies, Terms of Use and other policies or terms that may apply to other GoPillar Academy’s or GoPillar’s websites before using such websites.

15. REPRESENTATION AND WARRANTY

The User expressly understands and agrees that:

15.1)  Use of the GoPillar Academy Services is at Your own risk. The Services are provided on an “as is” and “as available” basis. You acknowledge and agree that no warranties of any kind, whether express or implied, are made by GoPillar Academy or its licensors, and GoPillar Academy and its licensors expressly disclaim any and all warranties of any kind, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

15.2) Neither GoPillar Academy nor its licensors make any warranty that:

1. The Services will meet Your requirements;
2. The Services will be uninterrupted, available for any length of time, secure or error-free;
3. The results that may be obtained from the User by the use of the Services will be accurate or reliable;
4. The quality of any products, services, information or other material purchased or obtained by You through the Portal or GoPillar Academy’s communications will meet Your expectations.

Any errors or defects in the Services will be corrected as best as possible by GoPillar Academy’s Team according to the total discretion of GoPillar Academy.

15.3) Any material uploaded/downloaded or otherwise obtained through the Portal is used at Your own discretion and risk; neither GoPillar Academy nor its licensors shall be liable, and You shall be solely responsible, for any loss or corruption of data uploaded, inputted or downloaded by You through the use of the Portal and for all maintenance, repair or correction and for any damage to hardware and software that may result from improper use of the Portal.

15.4) As a condition of Your use of the Portal, You warrant to GoPillar Academy that You will not use the Portal or our Services for any purpose that is unlawful or prohibited by these Terms of Use or by Law. You agree not to obtain or attempt to obtain any materials or information not intentionally made available on the Portal by GoPillar Academy’s Team.

15.5) GoPillar Academy will not be liable for service interruptions due to: – natural catastrophes or fortuitous event; – tampering on the services or on the equipment, carried out by the User or by third party; – wrong use of the services by the User; – faulty operation of the connection devices used by the User, even when it is due to the non- observance of the laws and rules on safety, prevention, accidents and industrial injuries.

15.6) It is particularly forbidden to use the service to cause in any way prejudice and/or harm to third parties or to commit or facilitate any type of crime.

16. TERMINATION AND LIABILITY

16.1) The Portal and all Services related to it are offered by GoPillar Academy to the User “as is” and “as available”, without any warranty,  be it direct or indirect, of any kind on its contents and/or its functionality. CoContest, therefore, does not offer any guarantee regarding the accessibility of the Portal at any time and/or place, nor does it offer guarantees regarding the absence of defects and/or errors in the Portal and/or its contents.

16.2) GoPillar Academy reserves the right at any time, and from time to time, to discontinue, temporarily or permanently, the Service or any part thereof or to terminate any User’s access to the Service or any part thereof. GoPillar Academy may also modify, delete or adapt the Service at any time without notice or obligation to You, in GoPillar Academy’s sole discretion. Your right to use and otherwise access the Service automatically terminates if You violate the Terms of Use. You agree that GoPillar Academy will not be liable to You or to any third party for any modification, suspension or discontinuance of the Service, or any part thereof. If You terminate this agreement for any reason, You must cease all access to the Service. All provisions of the Terms of Use regarding limitations and exclusions of warranties, limitations of liability, GoPillar Academy’s proprietary rights, and Your representations and indemnifications shall survive termination.

16.3) In no event shall GoPillar Academy or its employees, agents, licensors or contractors be liable for any direct, indirect, incidental, special, consequential, punitive or exemplary damages arising, damages for loss of profits, goodwill, use of data, or other intangible losses (even if such party has been advised of the possibility of such damages), resulting from:

1. The loss of data and/or the use or the inability to use the Service;
2. The cost of procurement of substitute goods and services resulting any goods, data, substitute goods and services purchased or obtained or messages received or transactions entered into through or from the service;
3. Unauthorized access to or alteration of Your transmissions ora data;
4. Statements or conduct of any third party on the service;
5. Any other matter relating to the Services.

16.4) You agree to indemnify and otherwise hold GoPillar Academy and its subsidiaries, affiliates, officers, agents, directors, licensors, contractors and employees harmless from any and all claims, actions, costs, liabilities, expenses and damages, including reasonable attorneys’ fees and legal fees, made against GoPillar Academy by any third party due to or arising out of Your misuse of the Service, Your connection to the Service, Your breach of any representation, warranty or covenant, Your violation of these Terms of Use, or Your violation of any right of another User.

16.5) GoPillar Academy always welcomes suggestions and comments regarding the Service. Any comments or suggestions submitted to GoPillar Academy’s Team, whether online or offline, will become the property of GoPillar Academy upon their submission. This policy is intended to avoid the possibility of future misunderstandings when projects developed by GoPillar Academy may seem similar to Your own contributions or comments.

17. GOVERNING LAW AND CONTACTS

17.1) These Terms of Use constitute the entire agreement between You and GoPillar Academy (CoContest INC.), regulate Your use of the Service, and supersede any prior agreements between You and GoPillar Academy concerning the Service. You may also be subject to additional Terms and Conditions that may apply when You use affiliated services, third-party content or third-party software (e.g. third party software licenses etc.).

17.2) The Terms of Use and the relationship between the User and GoPillar Academy will be governed by the laws of the State of California without regard to its conflict of law provisions.You and GoPillar Academy agree to submit to the personal and exclusive jurisdiction of the Courts located within the County of San Francisco, State of California. 

17.3) The failure of GoPillar Academy to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the Terms of Use must be filed within one (1) year after such claim or cause of action arises source or be prescribed forever.

17.4) All notices, requests, demands and other communications under this agreement must be in writing and adequately addressed:
